Please read these Terms and Conditions carefully before using the Happy Birthday Extension ("Service") operated by Digital ADgency ("us," "we," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

1. Description of Service

Happy Birthday Extension is a Google Chrome browser extension that automates the posting of birthday messages to your Facebook friends on their birthdays. The extension operates within your own Facebook browser session and does not access Facebook's API.

2. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

3. Subscription and Payment

• Free Trial: New accounts receive a 14-day free trial. A valid payment method is required to start the trial.
• Monthly Plan: $9.99 per month, billed monthly after the trial period.
• Annual Plan: $97.00 per year, billed annually after the trial period.
• Lifetime Plan: $297.00 one-time payment for lifetime access to the Service.
• All payments are processed securely by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

4. Cancellation and Refunds

You may cancel your subscription at any time from within the extension (Settings → Cancel Subscription) or by contacting us. Upon cancellation, you will retain access to the Service until the end of your current billing period. We do not offer refunds for partial billing periods. Lifetime plan purchases are non-refundable after 30 days.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service to send spam, harassing, or inappropriate messages
• Use the Service in violation of Facebook's Terms of Service
• Attempt to reverse engineer, modify, or create derivative works of the extension
• Share your account credentials with others
• Use the Service to send messages to people who have not consented to receive them

6. Facebook Compliance

The Happy Birthday Extension operates within your personal Facebook session. You are solely responsible for ensuring your use of the Service complies with Facebook's Terms of Service and Community Standards. We are not responsible for any actions taken by Facebook against your account, including but not limited to account restrictions, suspensions, or bans.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTY REGARDING THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SERVICE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Service Availability and Changes

We reserve the right to modify, suspend, or discontinue the Service at any time. Facebook regularly updates its platform, which may affect the functionality of the extension. We will make commercially reasonable efforts to maintain compatibility but cannot guarantee uninterrupted operation. "Lifetime" access refers to the lifetime of the extension/service as operated by us, not the customer's lifetime.

10. Intellectual Property

The Service, including all software, content, and trademarks, is owned by Digital ADgency and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the extension for personal use only.

11. Governing Law

These Terms shall be governed by the laws of the State of Texas, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Texas.

12. Changes to Terms

We reserve the right to update these Terms at any time. We will provide notice of material changes by email. Continued use of the Service after changes constitutes acceptance of the new Terms.
