Acceptance of Terms
By installing or using the Happy Birthday Extension (the "Extension"), or by using our website at happybirthdayextension.com (the "Site"), you agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the Extension or the Site.
The Extension and Site are operated by Digital ADgency ("we," "us," or "our").
What the Service Does
The Extension is a Chrome browser extension that, while you are logged into your own Facebook account, automatically posts birthday messages on your friends' Facebook walls. The messages are based on templates you configure. You retain full control: you choose the templates, you can blacklist any friend, and you can pause or cancel at any time.
Your Account
To use paid features of the Extension, you must create an account using your email address. You are responsible for keeping your login credentials secure. You must be at least 13 years old to use the service.
You agree to provide accurate and current information when signing up and to update it as needed.
Subscription Plans & Billing
$1 Trial
New users may try the Extension for $1 for 30 days. After the trial period ends, your subscription will automatically renew at the standard monthly rate of $9.99 per month, billed monthly, unless you cancel before the trial ends.
Monthly & Annual Plans
Standard plans are billed automatically on a recurring basis (monthly or annually, depending on the plan you select) until cancelled. You can cancel at any time from your account dashboard or by contacting us. After cancellation, you will retain access through the end of your current billing period.
Lifetime Plan
The Lifetime Plan is a one-time payment of $297 that grants ongoing access to the Extension for the lifetime of the product.
Payment Processing
All payments are processed by Stripe. By providing your payment information, you authorize us (through Stripe) to charge your payment method for the applicable fees.
Refund Policy
Acceptable Use
You agree not to use the Extension or the Site to:
- Violate any law or regulation
- Send spam, harassing messages, or content that violates Facebook's terms of service
- Impersonate another person
- Interfere with or disrupt the Extension or its underlying infrastructure
- Attempt to reverse engineer, decompile, or extract source code from the Extension
- Resell, sublicense, or redistribute the Extension without our written permission
You are responsible for the content of the birthday messages you configure. You agree that those messages will be friendly, appropriate, and welcome to the recipients.
Facebook's Terms
The Extension operates within your own Facebook account. Your use of Facebook is governed by Facebook's own Terms of Service and policies. We are not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. We are not responsible for actions Facebook may take regarding your account, including but not limited to rate limits, warnings, or suspensions.
Intellectual Property
The Extension, the Site, and all related content (including code, design, text, graphics, and logos) are owned by us or our licensors and are protected by U.S. and international copyright and trademark laws. We grant you a limited, non-exclusive, non-transferable license to use the Extension for personal, non-commercial purposes in accordance with these Terms.
Disclaimers
THE EXTENSION AND SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE EXTENSION WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH FUTURE CHANGES TO FACEBOOK'S PLATFORM. WE MAKE NO WARRANTY THAT THE EXTENSION WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
Birthday messages are posted based on what Facebook displays as today's birthdays. If Facebook does not show a friend's birthday, the Extension cannot post for that friend. We are not responsible for missed birthdays caused by Facebook UI changes, account restrictions, network issues, or anything outside our control.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE EXTENSION OR SITE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATED TO THESE TERMS OR THE EXTENSION WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
Indemnification
You agree to indemnify and hold us harmless from any claims, losses, or damages (including attorneys' fees) arising from your use of the Extension, your violation of these Terms, or your violation of any rights of a third party.
Termination
You may stop using the Extension at any time by cancelling your subscription and uninstalling it from Chrome. We may terminate or suspend your access if you violate these Terms, if your account is associated with fraud or abuse, or if we discontinue the service. On termination, your rights under these Terms end immediately.
Changes to These Terms
We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top of this page. If the changes are material, we'll notify you by email or a notice on the website. Continued use of the Extension after changes take effect constitutes acceptance of the new Terms.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising from these Terms or the Extension will be resolved in the state or federal courts located in Dallas County, Texas, and you consent to the jurisdiction of those courts.
